New Auto Insurance Law Signed Into Law

Gov. Scott signed into law a new auto insurance that will drastically reduce how much of your medical bills will be paid by under your PIP coverage. You will pay for $10,000 worth of coverage but your insurance will likely only pay $2,500 of your bills. You must get treatment within 14 days of the accident or nothing will be paid. A herniated disc injury, like Dwight Howard’s which required surgery, may leave you with thousands of dollars of medical bills as your responsibility. The worst part is that your insurance payments will not go down but you will have less insurance. Maybe in 2014, premiums will be reduced but only maybe. This law goes into effect on July 1, 2012. You need to make sure you have health insurance coverage or you will likely have some large medical bills hanging over your head if you get hurt in an auto accident after July 1.

Unrestrained Teenager Dies in Car Wreck

Another Central Florida teenager was ejected from her car and died. She was a passenger in the back seat at the time of the accident. The belted driver survived. We urge everyone to wear your seatbelt at all times and wear it correctly! Seat belts do work. A trooper once told me that he had never unbuckled a dead person from a car crash. Not wearing your seatbelt can lower the amount you can recover for your injuries. If you have questions about your legal rights, call us at Wieland, Hilado & DeLattre, P.A. 407-841-7699 or visit us at WhenJusticeMatters.com

Tractor Trailor Crash On I-4 At Fairbanks Curve

The deadliest curve in Orlando is stii not fixed. One week after the DOT spent thousands of dollars carving grooves in the road another tractor trailer crashes on the Westbound side. The grooves may help drain water but they don’t improve traction. Why don’t they straighten out the curve? Well, it might be that some well connected people live in the way. We don’t want to disturb College Park! If this were Parramore, it would have been straightened out and fixuse years ago. No Traffic Tickets For Police Chief

Davie, Florida police chief was found to be at fault when his police cruiser hit a child bicyclist. Yet, he was not given a ticket. Why? Are they never wrong or do they just protect their own? Read the full story. http://www.orlandosentinel.com/fl-davie-chief-accident-20120322,0,153891.story?track=osiphoneapp. We represented a young man on his way to get a haircut and was killed when his car was struck during an improper police chase. The Orlando Police Department has never admitted they were wrong and have never apologized to the family for contributing to their son’s death. They refuse to admit they did anything wrong. No officer was charged with anything and no officer was disciplined. OPD did it’s own investigation of it’s own police officers. Isn’t this the fox watching the hen house? Why doesn’t an independent review board review matters like these with the ability to issue citations and discipline officers? Because they don’t want an independent review. Call us if you have a case like this for a free consultation. Wieland, Hilado DeLattre. 407-841-7699

New Law Allows Insurance Companies To Collect Excess Profits

It is hard to believe that the Florida Legislature passed a bill allowing insurance companies to collect “EXCESS PROFITS”. The Senate failed to take up the House bill but the Senate in a sneaky attached the language to another insurance bill on the last day of the legislative session and now allows insurance companies to collect “EXCESS PROFITS”. Insurance lobbyists were able to convince our Legislators that it would a good idea for Insurance Companies to collect “Excess Profits”. Really, this did happen and it is not just a dream. With a tough economy and consumers and employers trying to pay their bills while gas prices and expenses are going up, Insurance Companies and the Florida House and Senate had to sneak this legislation into law. Leadership of the Senate knew that HB 4169 would not have passed unless it was attached to another bill. Who thinks that it is a good idea to let insurance companies to collect Excess Profits and then increase premiums to businesses?
The law requiring insurance companies to return to its policy holders “EXCESS PROFITS” has been in effect for over 32 years and has worked to save Florida businesses millions of dollars. Insurance companies were ordered to return over $200 million since the 2003 reforms. They did not do it voluntarily, they were ordered to do return these monies to Florida businesses. Now businesses will pay higher premiums because our Legislature has approved insurance companies to collect Excess Profits with no oversight or consumer protection. All businesses should ask, Why didn’t the Chamber of Commerce protect businesses from this bad bill?
